All right.
MR. MERRETT:
Judge, I wondered, then, if the
Court could enlighten me as to the point at which the
Church of Scientology became a party to the proceedings
because they don’t appear to be named in the pleading.
 
THE COURT:
Interesting point. Mr. Pope?
MR. POPE:
Your Honor, your order that you
issued recites that it is binding upon all persons acting
in active concert and participation with various people.
When you issued your initial injunction in
December of 1999, the Church of Scientology considered
itself to be in the active concert and participation of
Mr. Howd, considered itself to be bound by the order,
although not a party to the matter, and has conducted
itself as if it were bound by the order because the order
pretty clearly puts the restrictions on persons affiliated
with the Church of Scientology Flag Service Organization.
 
And for that reason, it doesn’t seem like that
big of a deal to me, at any rate, that Mr. Shaw is sitting
here with me as a representative of the Church of
Scientology Flag Service Organization.
 
THE COURT:
Okay. I think, interestingly, I
heard that you did state that the Church and all parties or
persons thereto have agreed to be bound by the order.
 
MR. POPE:
Well, I think they don’t have any
