THE COURT: Slowly, sir.
 
MR. POPE:
Okay. We’re here today, Your Honor,
on Petitioner’s motion for extension of amended temporary
injunction.
 
Frankly, I didn’t realize that we were going to
get all tied up in collateral issues here for more than an
hour, but we’ve gotten that behind us. I’m going to do my
best to speed it up. I do have a logistical question to
ask of opposing counsel, and that is whether they are going
to call live witnesses today.
 
MR. HOWIE:
I anticipate calling Mr. Minton.
MR. MERRETT: It’s our position that we do not
have the burden of going forward until some witnesses have
been produced on competent matters by the Petitioner; and
the Petitioner being, presumably, one of the parties in
interest being absent, it doesn’t look like there’s going
to be any competent testimony. If that’s the case, then we
wouldn’t be.
 
MR. POPE:
Your Honor, may I proceed from
counsel table?
 
THE COURT: You may, sir. And let me say,
again, for the purposes of this record, we will operate the
way we’ve operated in the past. If you’re comfortable
sitting and arguing, do it. If you feel that you have to
be on your feet to make a more eloquent presentation,
