THE COURT: I’m going to take a short break,
get this case and come back and announce my decision in
just a minute.
 
(Thereupon, a brief recess was held until 5:30

THE COURT: All right. Attorneys, thank you
very much for a well-argued case. Folks, I’m deeply
concerned here. We’re faced with a problem. We’ve been
living a ruse and we can’t keep it up. I understand the
bubble case and I understand Olan’s Miami Rental.
 
This came to me strictly as a matter between
Howd and Minton; and following the language, I put in there
their agents and all trying to temporarily bring this thing
to some sort of a resolution so there would be some peace
and order. And there’s been peace and order; I mean,
everything is working. But Howd is not a real priority
interest in this thing.
 
There is absolutely no showing today that Howd
is in any danger. Now, there’s a bigger issue here, and I
recognize it just as sure as I’m sitting here; but with the
state of this file and the record in front of me, I can’t
do anything, so I can’t continue this.
 
And that’s all I can do. Give me an order.
